By downloading, installing, or using Cuando Sky ("the App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

You must be at least 13 years of age to use this App. These terms apply to all users of the App, including visitors, registered users, and any other persons who access or use the App's services.

3. Weather Service Terms

Cuando Sky provides weather forecasting services based on your location and various meteorological data sources. The App is intended for personal, non-commercial use only.

Weather data and forecasts are sourced from reputable meteorological providers. While we strive to deliver accurate and timely information, weather predictions are inherently uncertain and should be used as general guidance only.

Premium features and subscription services, where available, are subject to additional terms. Subscription fees are non-refundable except as required by applicable law or as expressly stated in our refund policy.

4. User Responsibilities

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You agree to provide accurate, current, and complete information when using the App and to update such information as necessary to keep it accurate and complete.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You acknowledge that weather conditions can change rapidly and unpredictably. Decisions made based on information from this App are made at your own risk. For severe weather events, always consult official emergency services and local authorities.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Cuando Sky and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

In no event shall our total liability exceed the amount you paid to us, if any, during the six months prior to the cause of action.

7. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, severe weather events, acts of government, internet or network outages, third-party service provider failures, or other unforeseeable events.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these terms or your use of the App shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

We reserve the right to modify or replace these Terms of Service at any time. We will provide notice of any material changes by posting the updated terms within the App or by other means.

Your continued use of the App after any changes to these terms constitutes your acceptance of the new Terms of Service.
